Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the RECON application and website at reconplus.pro (the “Service”), provided by RECON PLUS PTY LTD (ABN 94 673 110 177) (“RECON”, “we”, “us”). By accessing or using the Service, you agree to these Terms.

1. Your account

You are responsible for the information you provide, for activity under your account, and for keeping your login credentials secure. You must provide accurate information and notify us of any unauthorised use.

2. Acceptable use

You agree not to:

  • use the Service unlawfully or in breach of these Terms;
  • attempt to gain unauthorised access to the Service or its systems;
  • interfere with or disrupt the integrity or performance of the Service;
  • upload content you do not have the right to use, or that is unlawful or infringing.

3. Your content

You retain ownership of the content and records you submit to the Service. You grant us a limited licence to host, process and display that content solely to operate and provide the Service to you and your organisation.

4. Service availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features from time to time.

5. Intellectual property

The Service, including its software, design and branding, is owned by RECON and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

6. Disclaimers

To the extent permitted by law, the Service is provided “as is” without warranties of any kind. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be lawfully excluded.

7. Limitation of liability

To the maximum extent permitted by law, RECON will not be liable for any indirect, incidental or consequential loss arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months before the claim, or, where the law implies warranties that cannot be excluded, to re-supplying the Service.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where reasonably necessary to protect the Service or other users.

9. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
